The second phase of the premium processing expansion is being implemented by US Citizenship and Immigration Services for certain petitioners who have a pending Form I-140, Immigrant Petition for Alien Workers, under the EB-1 and EB-2 classifications.
This phase, like the first and second phases of the expansion, only applies to previously filed Form I-140 petitions seeking a national interest waiver under an E13 multinational executive and manager classification or E21 classification as a member of professions with advanced degrees or exceptional ability (NIW).
Petitioners who want to request premium processing must submit Form I-907, Request for Premium Processing Service.
As from the beginning September 15, 2022, the USCIS will accept Form I-907 requests for:
- Petitions for E13 multinational executives and managers received on or before January 1, 2022;
- E21 NIW applications received by February 1, 2022.
If the receipt date falls after these dates, the USCIS will refuse premium processing requests for these Form I-140 classes. They have 45 days to make a decision on cases requesting premium processing for these newly added Form I-140 classes. At this time, they will not accept new (first) Forms I-140 with a premium processing request.
They issued a revised version of Form I-907 (PDF, 378.35 KB), dated 05/31/22, on May 24, 2022. They no longer accept the earlier 09/30/20 edition of form I-907 as of July 1.
The USCIS is expanding premium processing to more form types, as previously stated, as part of our efforts to boost efficiency and decrease constraints on the broader legal immigration system. As they phase in the extension of premium processing and will continue to work toward the availability of premium processing for new Form I-140 petitions, Form I-539, Application to Extend/Change Nonimmigrant Status, and Form I-765, Application for Employment Authorization. They will also follow the statutory requirement that the growth of premium processing not result in longer processing times for normal immigration benefit petitions.
